§ 1 Scope and provider

(1) These Terms and Conditions apply to all orders placed by consumers and businesses through the online shop wearetomorrowpeople.com.

(2) The provider and contracting party is: Plan A GmbH, Metzer Straße 50, 66117 Saarbrücken, Germany · represented by managing director Felix Rüdiger · Local Court (Amtsgericht) Saarbrücken HRB 17899 · VAT ID DE265453362 · email: hello@wearetomorrowpeople.com ("we").

(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code). Deviating terms of the customer do not become part of the contract unless we expressly agree.

§ 2 Conclusion of contract

(1) The presentation of products in the shop does not constitute a legally binding offer, but an invitation to order.

(2) By clicking the "order with obligation to pay" button, you submit a binding offer to purchase the items in your cart.

(3) After submitting your order you receive an automatic confirmation of receipt by email. This does not yet constitute acceptance of your offer. The contract is concluded once we declare acceptance or ship the goods and confirm this by a shipping confirmation.

(4) We store the contract text and send you the order details by email.

§ 3 Prices and shipping costs

(1) All prices are final prices and include statutory VAT.

(2) Shipping costs may apply in addition to the product prices: Germany: free standard shipping. EU: €10. Switzerland: free (priced in CHF; handled via our partner MeinEinkauf.ch — see § 5a).

(3) The exact shipping costs are shown to you during the order process before you complete your order.

§ 4 Payment

(1) The available payment methods are shown during the order process (incl. credit/debit cards with Apple Pay and Google Pay, PayPal, Klarna).

(2) The purchase price is due for payment upon conclusion of the contract. Processing is handled by the payment provider you choose, under its terms.

§ 5 Delivery and shipping

(1) Shipping is carried out by DHL to the delivery address you provide.

(2) Within Germany, delivery usually takes 1–3 business days after shipping confirmation. For deliveries abroad, transit times may differ.

(3) If a product is unavailable at the time of your order, we will inform you without undue delay and refund any payments already made.

§ 5a Deliveries to Switzerland (handled via MeinEinkauf)

(1) Orders with a delivery address in Switzerland are handled via our partner MeinEinkauf GmbH, Maybachstraße 19, 78467 Konstanz. We ship the goods domestically within Germany to MeinEinkauf; MeinEinkauf handles import and customs clearance into Switzerland, invoicing you, and delivery.

(2) For deliveries to Switzerland, prices are shown in Swiss francs (CHF); shipping to Switzerland is free of charge for you.

§ 6 Retention of title

The delivered goods remain our property until full payment has been received.

§ 7 Right of withdrawal and returns

(1) Consumers have a statutory 14-day right of withdrawal. Details are set out in our Right of Withdrawal notice, including the model withdrawal form.

(2) You bear the direct cost of returning the goods.

(3) Please return the goods unworn and complete (including case and accessories) and in original, resalable condition. You are liable for any loss of value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods (§ 357a German Civil Code). Simply trying them on — as you could in a store — is not covered by this.

(4) Beyond the statutory right of withdrawal, we do not grant a voluntary right of return.

§ 8 Warranty / liability for defects

The statutory law on liability for defects applies. In the event of defects, you have the statutory rights. Contact for complaints: hello@wearetomorrowpeople.com.

§ 9 Liability

(1) We are fully liable for damages arising from injury to life, body or health, and in cases of intent and gross negligence.

(2) In the event of slightly negligent breach of essential contractual obligations (cardinal obligations), our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded. Mandatory statutory provisions (in particular the German Product Liability Act) remain unaffected.

§ 10 Dispute resolution

(1) The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 German Act on Consumer Dispute Resolution, VSBG).

§ 11 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.

(2) Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
